If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Platform.

Lusty.now is an artificial intelligence-powered video generation platform that enables users to create synthetic video content through the use of machine learning models and generative AI technology. The Service operates on a prepaid credit-based system, whereby users purchase credits in advance to generate video content.

3. Eligibility and User Accounts

3.1 Age Requirement

You must be at least eighteen (18) years of age to use the Platform. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.2 Account Registration

To access certain features of the Platform, you must register for an account. You agree to:

  • •Provide accurate, current, and complete information during registration
  • •Maintain and promptly update your account information
  • •Maintain the confidentiality and security of your password and account credentials
  • •Accept responsibility for all activities that occur under your account
  • •Notify us immediately of any unauthorized access to or use of your account

3.3 Account Security

You are solely responsible for maintaining the security of your account. Lusty.now shall not be liable for any loss or damage arising from your failure to protect your account credentials.

4. Credits, Payment, and Refund Policy

4.1 Credit-Based System

The Platform operates exclusively on a prepaid credit-based system. Credits must be purchased prior to generating any video content.

4.2 Payment Methods

Credits may be purchased through various payment methods, including but not limited to cryptocurrency, credit cards, and other electronic payment systems as made available on the Platform.

4.3 Non-Refundable Purchases

ALL CREDIT PURCHASES ARE FINAL AND NON-REFUNDABLE. By purchasing credits, you acknowledge and agree that:

  • •Credits constitute digital goods delivered immediately upon purchase
  • •Due to the nature of digital goods and the immediate delivery of credits to your account, no refunds will be issued under any circumstances
  • •Cryptocurrency transactions are irreversible by their technical nature, and no refund mechanism exists for such payments
  • •No refunds will be provided for unused credits, dissatisfaction with generated content, account termination due to Terms violations, or any other reason

4.4 Pricing

Credit prices are subject to change at our sole discretion. We may offer promotional pricing, discounts, or special offers at any time without prior notice. Such promotions do not entitle existing credit holders to price adjustments.

4.5 Credit Expiration

Unused credits do not expire while your account remains in good standing. However, upon account termination for any reason, all unused credits are forfeited without compensation.

5. AI-Generated Content Disclaimer

5.1 Nature of AI-Generated Content

You acknowledge and understand that all video content generated through the Platform is created by artificial intelligence systems. AI-generated content is provided strictly on an "AS IS" and "AS AVAILABLE" basis.

5.2 AI Limitations and Hallucinations

You expressly acknowledge that AI video generation models may:

  • •Hallucinate or fabricate content: Generate representations of non-existent people, places, objects, or scenarios that have no basis in reality
  • •Produce anatomical inaccuracies: Create visual artifacts, deformities, distortions, or unnatural representations of human bodies, faces, limbs, and other anatomical features
  • •Generate background errors: Produce inconsistencies, artifacts, or anomalies in video backgrounds and environments
  • •Create temporal inconsistencies: Exhibit frame-to-frame variations, morphing, or instability in generated content
  • •Misinterpret prompts: Produce results that differ materially from user expectations or input descriptions

5.3 No Guarantee of Quality or Accuracy

Lusty.now makes no representations, warranties, or guarantees regarding:

  • •The quality, accuracy, or realism of generated content
  • •The consistency or reproducibility of results
  • •The suitability of generated content for any particular purpose
  • •The absence of errors, artifacts, or imperfections

5.4 Acceptance of Variability

By using the Service, you accept that AI-generated content is inherently variable and unpredictable. Credit charges apply regardless of whether the generated output meets your subjective expectations.

6. Service Availability and Performance

6.1 On-Demand Infrastructure

The Platform utilizes on-demand computing infrastructure, including GPU servers that may require initialization or "warm-up" periods. You acknowledge that:

  • •Video generation times may vary significantly based on server availability and demand
  • •Processing delays may occur during periods of high usage, server maintenance, or infrastructure scaling
  • •GPU servers may need to be provisioned on-demand, resulting in extended wait times

6.2 No Uptime Guarantee

Lusty.now does not guarantee uninterrupted access to the Platform. The Service may be unavailable due to:

  • •Scheduled or emergency maintenance
  • •Infrastructure upgrades or migrations
  • •Third-party service provider issues
  • •Technical difficulties beyond our reasonable control
  • •Force majeure events

6.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, without liability to you.

7. User Responsibilities and Prohibited Uses

7.1 Sole Responsibility

You are solely and exclusively responsible for:

  • •All uses to which you put generated content
  • •Compliance with all applicable laws and regulations in your jurisdiction
  • •Any consequences arising from your use of the Service

You agree not to use the Platform to:

  • •Produce content that infringes upon the intellectual property rights of third parties
  • •Generate deepfakes, synthetic media, or impersonations intended to deceive, defraud, defame, or harm any person
  • •Create content for purposes of harassment, bullying, intimidation, or threats
  • •Produce content that promotes violence, terrorism, or illegal activities
  • •Generate content that violates our Prohibited Content Policy

7.3 Compliance with Laws

You are responsible for ensuring that your use of the Platform and any generated content complies with all applicable laws, regulations, and third-party rights in your jurisdiction and any jurisdiction where the content may be distributed or viewed.

8. Disclaimer of Liability for Misuse

8.1 No Liability for User Actions

Lusty.now shall not be held responsible, liable, or accountable for any misuse of the Platform or generated content by users, including but not limited to:

  • •Creation or distribution of deepfakes or synthetic impersonations
  • •Use of generated content to deceive, defraud, or mislead others
  • •Defamation, harassment, or harm caused through generated content
  • •Infringement of third-party intellectual property rights
  • •Any illegal activities conducted using the Platform or generated content

8.2 User Indemnification

You agree to indemnify, defend, and hold harmless Lusty.now, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • •Your use of the Platform
  • •Your violation of these Terms
  • •Your violation of any applicable law or third-party rights
  • •Any content you generate or distribute using the Service

9. Intellectual Property

9.1 Platform Ownership

The Platform, including its design, features, functionality, underlying technology, trademarks, and all related intellectual property, is owned by Lusty.now and is protected by international copyright, trademark, patent, and other intellectual property laws.

9.2 Generated Content

Subject to compliance with these Terms, you retain rights to content you generate using the Platform. However, you grant Lusty.now a non-exclusive, royalty-free license to use, store, and process generated content as necessary to provide and improve the Service.

10. Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

11. Termination and Account Suspension

11.1 Termination by User

You may terminate your account at any time by contacting our support channels. Upon termination, all unused credits are forfeited.

11.2 Termination by Lusty.now

We reserve the right, at our sole discretion, to:

  • •Suspend or terminate your account immediately, without prior notice
  • •Refuse service to any user for any reason
  • •Remove or disable access to any content
  • •Take any action we deem necessary to protect the Platform, our users, or third parties

11.3 Grounds for Termination

Account termination may occur for reasons including, but not limited to:

  • •Violation of these Terms or any applicable policies
  • •Generation of prohibited content
  • •Fraudulent, abusive, or illegal activity
  • •Conduct that harms the Platform, other users, or third parties
  • •Request by law enforcement or government agencies
  • •Extended periods of inactivity
  • •Any other reason at our sole discretion

11.4 Effect of Termination

Upon termination:

  • •Your right to access and use the Platform ceases immediately
  • •All unused credits are forfeited without refund or compensation
  • •We may delete your account data and generated content
  • •Provisions of these Terms that by their nature should survive termination shall remain in effect

12. Disclaimers and Limitation of Liability

12.1 Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUSTY.NOW, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • •Your use of or inability to use the Platform
  • •Any content generated through the Service
  • •Unauthorized access to or alteration of your data
  • •Any third-party conduct on the Platform
  • •Any other matter relating to the Service

12.3 Maximum Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO LUSTY.NOW IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

13. Modifications to Terms

13.1 Right to Modify

We reserve the right to modify, amend, or update these Terms at any time and at our sole discretion. Changes will be effective immediately upon posting to the Platform unless otherwise specified.

13.2 Notification of Changes

We will make reasonable efforts to notify users of material changes to these Terms through email, platform notifications, or prominent posting on the website. However, it is your responsibility to review these Terms periodically.

13.3 Acceptance of Changes

Your continued use of the Platform following any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Platform.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Lusty.now operates, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

14.3 Class Action Waiver

To the extent permitted by law, you waive any right to participate in class action lawsuits or class-wide arbitration against Lusty.now.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy and Prohibited Content Policy, constitute the entire agreement between you and Lusty.now regarding your use of the Platform and supersede all prior agreements, representations, and understandings.
